Morgan, Colorado 80701 <br />March 29, 1985 <br />Re: File No. 77-94, Westhoff Pit <br />Dear Mr. Westhoff: <br />On March 28, 1985 the Colorado Mined Land Reclamation Board found that there <br />is reason to believe that a violation to the permit for the above captioned <br />operation has occurred. <br />A Formal Public Hearing will he held during the April 24-25, 1985 Board <br />meeting for consideration of violation, cease and desist order, corrective <br />action(s) and civil penalty for the violation. The hearing will be held in <br />Room 110 of 1313 Sherman Street, Denver, Colorado beginning at 9:00 a.m. or <br />as soon thereafter as the matter can be considered and you w?,11 have the <br />opportunity to be represented and heard. It will be reiterated that you have <br />been in violation of the permit, specifically the following provisions: <br />Failure to provide annual fees and annual reports as required by <br />34-32-116(1)(a), C.R.S. <br />If the Board finds a violation at this hearing, it may set the matter for <br />consideration of permit revocation and forfeiture of the $13,000.00 financial <br />warranty at a subsequent hearing. <br />IF YOU WANT TO AVOID THESE CONSEQUENCES, PLEASE SUBMIT $350.00 FOR ANNUAL FEES <br />AND AN ANNUAL REPORT FOR 1984 AS DESCRIBED IN 34-32-116(1)(a), C.R.S., BY <br />APRIL 19, 1985. <br />If you have any questions, please contact us. <br />Sincerely, <br />~ ~ <br />j 4~ <br />Edward L.
