Walther <br />350 High Flume Loop E:eculive D,re<lor <br />Duran o <br />CO 81303 <br />g M,chael R long <br />, Div~s~on Director <br />RE: High Flume Gravel Pit, Permit No. M-1990-093_~ <br />~----- Reason To Believe Violations Exist <br />Dear Mr. Trenkle: <br />On February 2, 2001 we conducted an inspection of the High Flume Gravel Pit and found that mining operations had <br />disturbed acreage outside the approved permit boundary. <br />We believe this is in violation of Section 34-32.5-1 l6(4)(i) of the Colorado Land Reclamation Act for the Extraction <br />of Construction Materials 34-32.5-101 et. seq. (C.R.S. 1984 and 1994 SUPP.) and Permit No. M-1990-093 Mine Plan <br />and Reclamation Plan Map. <br />Therefore, we have found reason to believe violations exist to Permit No. M-1990-093 and the Law and have scheduled <br />this matter before the Mined Land Reclamation Board (Board). <br />A Formal Public Hearing will be held at the March 2]-22, 2001 Board meeting for consideration of a possible <br />violation. The hearing will be held in Room 318 of 1313 Sherman Street, Denver, Colorado, beginning at 9:00 a.m. <br />or as soon thereafter as the matter can be considered. At that hearing you will have the opportunity to be represented <br />and heard. It will be reiterated that there is reason to believe that you aze in violation of the provisions noted above. <br />Please call this office on Monday, March 19, 2001, to verify which day your hearing will be held. <br />If the Board fmds a violation at this hearing, it may issue a Cease and Desist Order, assess a Civil Penalty in the amount <br />of $100.00 to $1,000.00 for each day of violation, and/or order the permit be suspended, modiFed, or revoked.
