Trapper Mine maintains that no violation <br />occurred or exists. There has been insufficient time, <br />however, to fully prepare Trapper's explanation for this <br />position. So, this response primarily addresses the <br />assessment criteria. Please note that Trapper has <br />voluntarily taken extraordinary measures to stabilize runoff <br />channels and ditches at the mine site. <br />According to Rule 5.04.5(3), the amount of the <br />assessed penalty is to be based on the history of previous <br />violations, the seriousness of the violation, fault, and a <br />monetary reduction for good faith. We intend to show that <br />the assessed penalty should be zero. <br />Historv <br />There have been no violations within the last <br />twelve months from the date of the NOV. Therefore, the <br />monetary assessment for history should be zero. <br />Seriousness <br />Seriousness in this instance should be based on the <br />extent of damage to the reclaimed landscape and damage to <br />water quality outside the permit area. There was no damage <br />of either type. <br />
