Trapper Mine maintains that no violation
occurred or exists. There has been insufficient time,
however, to fully prepare Trapper's explanation for this
position. So, this response primarily addresses the
assessment criteria. Please note that Trapper has
voluntarily taken extraordinary measures to stabilize runoff
channels and ditches at the mine site.
According to Rule 5.04.5(3), the amount of the
assessed penalty is to be based on the history of previous
violations, the seriousness of the violation, fault, and a
monetary reduction for good faith. We intend to show that
the assessed penalty should be zero.
Historv
There have been no violations within the last
twelve months from the date of the NOV. Therefore, the
monetary assessment for history should be zero.
Seriousness
Seriousness in this instance should be based on the
extent of damage to the reclaimed landscape and damage to
water quality outside the permit area. There was no damage
of either type.
