RESOURCES <br />IN THE MATTER OF: NOTICE OF VIOLATION M-95-069 <br />Thompson Properties ) AND <br />P.O. Box 3 ) CEASE AND DESIST ORDER <br />Granby CO 80446 ) <br />TO: Mr. Ron Thompson and all other persons engaged in or owning or controlling the <br />following operation: Horn Gravel Pit, Permit No. M-83-102. <br />FINDINGS OF FACT <br />Pursuant to the authority vested in the State of Colorado Mined Iand Reclamation <br />Board by C.R.S. 34-32-124, the Board hereby makes the following findings of fact: <br />1. Thompson Properties is permitted to conduct a mining operation under the terms of <br />Permit M-83-102 located in portions of Section 31, Township 2N, Range 76W, of the 6th <br />P.M., in Grand County, Colorado. <br />2. The Mined land Reclamation Board conducted a Formal Public Hearing on October <br />18, 1995 to consider possible violation of the terms of Permit M-83-102 and C.R.S. 34-32- <br />101 et sec . <br />3. The Division of Minerals and Geology presented evidence at the Formal Public <br />Hearing on October 18, 1995 demonstrating that: <br />Operator has failed to protect areas outside the permit area from damage during <br />the mining operation and reclamation. <br />
