Ln~hheaJ <br />E ~i niirve Dori mr <br />michacl R Lung <br />Div i~iun Durant <br />Yesterday I spoke with Mike Ward (U.S. Forest Service;Paonia) <br />regarding the pending land swap to occur between Mountain Coal Co. <br />and the Forest Service. The swap will involve land to be disturbed <br />following Permit Revision No. 7 approval. Ward speculates that the <br />land swap will close on April 29, 1997, and that there do (tot <br />appear to be any problems that would delay the closing. If the <br />swap occurs, then the Sylvester Gulch expansion (PR07) would not <br />involve any Forest Service land. <br />Ward and I agreed that we should attach a stipulation to any <br />proposed decision issued by DMG in the near future that requires <br />Mountain Coal Co. to submit either proof of land ownership pursuant <br />to the swap, or obtain Forest Service concurrence prior to <br />disturbance of lands which are now managed by the Forest Service. <br />I informed Christine Johnston of this decision this morning. <br />
