As of the last Board action of March 27, 1'
my impression that either you would permit this operation, or anotl
would succeed to the approved application on the site and permit i
choice was to be made, as I understood it, within the near future.
the case, I chose not to follow up on this matter immediately.
To date, no action has been taken to complete the permitting of thi
operation. I reviewed the J & J Pit file and found that condition
Cease and Desist Order for this operation is that you:
it 110
incial
185, it was
ier company
.. The
This being
s
3 of the
"Obtain a mining and reclamation permit for this operation submit an
application, obtain Board approval, and submit adequate fin ncial and
performance warranties) by March 27, 1985."
This condition has obviously not been met. It was the Board's int nt that
this operation be permitted in a timely manner, and that is why th s time
limit was set.
Your failure to complete the permitting process by the date mandat d by the
Board could itself be considered to be a violation to a Board orde Given
the time lag of over two months, I feel that some further action s ould be
taken. Please either submit performance and financial warranties to allow a
permit to be issued to you) or make arrangements to transfer the a proved
permit application to another party (form enclosed) by no later th n
July 1, 1985. If one of these two actions has not occurred, I wil plan to
bring this matter before the Board during the July 24-25, 1985 mee ing (to be
held here in Denver) for further discussion and possible action. ou would
receive separate notice of any such meeting after July 1, 1985.
423 Centennial Building, 1313 Sherman Street Denver, Colorado 80203 Tel.~(303) 866-3567
