Long <br />prvisian Director <br />The Division has reviewed the application for the Terror Creek Loadout, which is <br />a plan for temporary and permanent disposal of non-coal waste at the loadout. <br />This plan was required as abatement steps to terminate Notice of Violation C-93- <br />071, which was written for burning non-coal waste. <br />In review of the disposal plan, on revised page 2.05-15R, the Division questioned <br />whether a burning permit was required in Delta County. I telephoned the Delta <br />County Health Department and was told that no burning of trash in open piles or <br />barrels is allowed. Therefore, this part of Terror Creek•a disposal plan will <br />require revision. Agricultural burning (i.e.-grasses and trees) ie allowed. <br />However, I am not sure if a permit for this type of burning ie necessary. If no <br />permit is necessary, then the portion of the disposal plan regarding burning of <br />the felled fruit trees is adequate. If a permit is required, then a statement <br />in the permit should be added which states that Terror Creek will obtain the <br />appropriate permits prior to burning. <br />Locations of disposal areas should be shown on the Facilities Map, Hap 5. Ae <br />this map ie currently being revised for Technical Revision No. 3, currently under <br />review by the Division, the locations should be added to the Hap during this <br />time. <br />The Division must make a proposed decision for this minor revision by July 12, <br />1993. As the disposal plan will have to be revised, it ie recommended that an <br />extension of the deadline for the proposed decision be requested. <br />Please call if you have any questions. <br />ly, <br />Christine E.
