The questioned document was placed on <br />record by myself approximately three month ago. They were placed <br />right in front of the document. <br />Problems have been encountered in the past with documents <br />being "lost" in the records of Garfield County. A few years ago, <br />the entire Volume I of our three volume permit document was "lost". <br />Volume II and III, then on record with the BLM office in Glenwood <br />Springs, were also lost. It got to a point when Garfield county <br />officials requested that NCIG furnish the county with one extra set <br />of every document so that the county could pass them on to the <br />opponents of the Coal Ridge No. 1 mine. <br />we were then requested to replace the respective volumes of <br />the permit. However, it was clearly recognized that the "missing" <br />of the document was not NCIG's fault. The replacement document was <br />rather expensive. <br />We request that the problem, which caused the issuance of the <br />captioned NOV, betreated the same way the problem with other <br />missing documents were handled in the past. NCIG will certainly <br />replace the document, but should not be fined for the county's <br />failure to safeguard records placed there for public inspection. <br />Your consideration of the matter and withdrawal of the NOV is <br />respectfully requested. <br />Si~nce~rely, t <br />E.
