BEFORE THE MINED LAND RECLAMATION BOARD <br />STATE OF COLORADO <br />FINDINGS OF FACT, CONCLUSIONS OF LAW, AND ORDER <br />IN THE MATTER OF THE ALLEGED VIOLATION OF JOHN RICHARD KURTZER AND RITCHEY'S <br />REDI-MIX, FILE NO. M-2002-053, MV-2002-017. <br />THIS MATTER came before the Mined Land Reclamation Board on September 18, 2002 at Denver, <br />Colorado for hearing on Respondent John Richard Kurtzer's request for an extension of the deadline for <br />abatement of a violation. Robert Dee, Esquire, appeazed on behalf of Respondent. Gregg Squire appeared on <br />behalf of the Division of Minerals and Geology (hereinafrer Division) and stipulated to an extension. The <br />Board, having considered the position of the parties, and having been otherwise fully informed in the premises, <br />hereby <br />ORDERS that the deadline of August 26, 2002 by which [he Respondent shall submit and obtain approval for <br />its permit application for the site in question, as established in the Boazd's July 18, 2002 Order, is hereby <br />extended to November 1, 2002.
