We <br />appreciate the opportunity to have discussed with y u BMRI's <br />concerns by phone on April 16, 1993. This letter is provided <br />to once again express our views on three critical matters <br />concerning the contract and initial report. <br />• Regarding the third party contract, BMRI ulrges the <br />Division to exercise its authority as contract <br />administrator to ensure no more sampling delays 9ccur. We <br />cite the contractual obligations of the third party to be <br />reasonably compliant to the agreed sampling schedule. <br />Further, it is sincerely BMRI's desire to resolve this <br />issue as soon as possible to demonstrate full facility <br />compliance to the citizens of the San Luis Valley. <br />Finally, I am confident both the Division and MRI have <br />other responsibilities requiring attention. T is added <br />backlog limits available time to get on V,~ith our <br />businesses. <br />Regarding the initial third party sampling report, BMRI <br />strongly voices its concern that the third party note for <br />the record and clearly in the report all sampling, protocol <br />breaches. Specifically, the transportation of known <br />process point samples mixed with non-process point <br />samples. It is imperative that any deviations from proper <br />sampling protocol be clearly elicited in the re ort. In <br />fairness to all parties involved, Dr. Ma st must <br />acknowledge this item in her report. <br />A second concern BMRI has regarding the reporrt is the <br />PQL's for cyanide detection. While we concur this is not <br />necessarily a concern to Dr. Maest, we do beli@ve it is <br />important that either the Division or Dr. Maesit clearly <br />note either in a cover sheet to the report (from the <br />Division) or in Dr. Maest's report the accepted PQL value <br />5670 GREENWOOD PLAZA BLVD.
