i Y • • <br />STAFF RECOMMENDATION: <br />Staff would recommend that the Board find a violation for failure to <br />maintain financial warranty as required by 34-32-117(6), issue a <br />cease and desist order with the corrective action that a new <br />financial warranty be submitted by November 14, 1986, with the <br />stipulation that upon receipt of financial warranty the Division <br />is authorized to lift the cease and desist, and schedule the matter <br />for consideration of civil penalty at the December Board Meeting. <br />Because of the circumstances involved; liquidation proceedings and <br />the difficulty being experienced by these operators to find insurance <br />companies that will write these types of bonds, the staff would <br />further recommend that if financial warranty is submitted by the <br />November 14 deadline date that the matter of civil penalty be dropped. <br />Staff would also recommend that if no financial warranty is submitted <br />that the matter be scheduled for revocation of permit and forfeiture <br />of financial warranty at the December Board Meeting. <br />' ~~, <br />~f <br />,~) ~ I <br />~~~ <br />~ ~ ; <br />~~ <br />l~ <br />
