.~ ~ • <br />-z- <br />NOTICE OF VIOLATION <br />Based upon these same findings of Fact and in accordance with <br />C.R.S. 34-32-124(6), the Colorado Mined Land Reclamation Board hereby finds <br />Yuma County to be in violation of Permit M-81-256 and C.R.S. 34-32-116(7>(h) <br />and Rules 2.1 and 6.1(2) of the Mineral Rules and Regulations of the Colorado <br />Mined Land Reclamation Board. <br />CEASE AND DESIST ORDER <br />Based upon these same Findings of Fact and Notice of Violation, and in <br />accordance with C.R.S. 34-32-124(2),(6) and (7) the Colorado Mined Land <br />Reclamation Board hereby orders Yuma County to: <br />1. Cease and desist from conducting the following mining operations at the <br />Ekberg Pit - Permit M-81-256: mining outside the present permit area. <br />2. Mail, within one (1) day after receipt of this Notice, to the Mined Land <br />Reclamation Board, written notice of your compliance with paragraph one (1) of <br />this Cease and Desist Order. <br />3. Complete the following corrective action: <br />a. File a conversion to a 112 permit to include all areas presently <br />disturbed and all areas necessary to achieve reclamation. <br />b. Submit the conversion no later tha 5 p.m., November 15, 1993. <br />c. Obtain an approved conversion by no later than 5 pm., <br />February 151994. <br />d. As an interim measure, Yuma County may submit a 111 application for <br />all disturbed acreage outside the present 110 permit by no later than <br />September 30, 1993. <br />4. The Colorado Mined Land Reclamation Board did not assess a civil penalty <br />at the hearing. <br />This Cease and Desist Order shall remain in effect until all terms have been <br />satisfied by the operator. <br />
