Cattany <br />Division Director <br />Natural Resource Trustee <br />This letter is written in response to your letters to the Division of Minerals and Geology <br />(DMG) dated April 13, 2004 (received April 13, 2004), dated April 13, 2004 (received <br />April 15, 2004) and dated May 5, 2004 (received May 5, 2004). <br />The letter dated April 13, 2004 and received April 13, 2004 acknowledges receipt of the <br />technical revision documents sent to you by DMG, and it expresses an objection <br />regazding the bond amount for the Permit No. C-1981-013. The total required and <br />submitted bond for the Permit No. C-1981-013 is $206,634.00. The total amount includes <br />$91,335.00 for the activities approved with Technical Revision No.55. The amount of <br />bond required for the Permit No. C-1981 is based upon the information provided and <br />reviewed within the related permitting documents and is deemed adequate at this time. <br />It must be noted that the bond-related objection was received after all comment and <br />objection periods expired. The Technical Revision No. 55 application was received by <br />DMG on December 23, 2003. A Technical Revision No. 55 application completeness <br />notification was sent to you on December 31, 2003. The December 31, 2004 notice <br />advised you of the comment and objection procedures associated with the subject <br />technical revision. A complete copy of the application materials was also sent to you with <br />the completeness notification of December 31, 2003. <br />On January 12, 2004, DMG received a letter from you dated January 9, 2004 in response <br />to the DMG completeness notice of December 31, 2004. The January 9, 2004 letter from <br />you referenced a Citizen's Complaint regazding water loss issues. On January 14, 2004, <br />DMG sent a letter to you acknowledging receipt of your Januazy 9, 20041etter, and <br />requesting clarification regazding the intent of your January 9, 20041etter. In the DMG <br />letter of Januazy 14, 2004, DMG stated in part, " It does not seem that the letter is an <br />objection to the Technical Revision 55, and we will proceed with our review of Technical' <br />Revision 55 with this understanding. Please notify us immediately if this understanding is <br />not correct". On January 19, 2004, DMG received a letter from Ann Tatum stating, " <br />With reference to your inquiry dated January 14, 2004 as to our citizens' complaint, <br />please consider our January 9, 2004 a new citizens complaint.
