Price <br />Deaz Randy and David: <br />On behalf of Kerr Coal Company, I am authorized to waive the deadline for the <br />Division's proposed decision on Kerr's application for Phase I bond release. <br />I understand there may be some confusion about the deadline for the proposed <br />decision. As you know, the Division completed and sent to Kerr the report on its <br />inspection and evaluation of the bond release application on May 25, 1994. Under C.R.S. <br />§ 34-33-125(4) (1993 Cum. Supp.), the Division is required to notify Kerr in writing of its <br />proposed decision within 60 days after completion of the inspection and evaluation, i.e., <br />by July 24, 1994. Prior to the amendment of section 125(4) and repeal of Rule <br />3.03.2(5)(a) and (b) by the General Assembly in 1992, the deadline for a proposed <br />decision was 30 days. <br />Although it is Kerr 's position that the 60-day deadline is the only one in effect, the <br />circumstances-of this-case makea~unnecessary to address which-is the currently <br />applicable deadline. It is appazent that the Division will not be able to complete its <br />proposed decision by either date. Among the contributory factors are Kerr's responses to <br />the adequacy comments in the report and the pending review of the Notice of Violation <br />S. KIRK INGEBRETSEN <br />DOUGLAS P.
