Long, <br />Division D~renor <br />I have reviewed the Pond 1 pond survey submittal for Abatement 2 of NOV <br />C-91-031. As you indicated in your cover letter, the pond has been cleaned tc <br />the 60X clean-out sediment level. The Division will accept this submittal as <br />abatement for this portion of the violation. It would be advisable however, <br />to clean the pond further to avoid subsequent violations, as any additional <br />contributions of sediment will result in non-compliance with Rule 4.05.6(3)(b) <br />Energy Fuels may want to re-consider the sediment storage volume needed in <br />this pond, after evaluating the frequency of cleaning and the volume of <br />material removed. This pond's sediment projections were calculated <br />unconventionally; the USLE equation was not used, rather ten percent of the <br />pond was dedicated for sediment storage (0.2 acre feet). A conservative <br />method for calcuiating sediment stooge is 0.1 acre feet/acre of disturbance. <br />The calculations suggest that the watershed for thist~l~ is 7.5 acres. The <br />pond has at least a 0.74 acre foot permanent pooi which could be reallocated <br />for sediment storage.
