Box 591 Michael B Long <br /> <br />Somerset, CO 81434 Division Director <br />Re: Abatement Extension -Notice of Violation CV-97-022 -Permit No. C-80-007 <br />Dear Mr. Schmidt: <br />The Division has reviewed your letter dated December 4, 1997, and the requested abatement step extension is <br />granted. This extension is allowed so that Mountain Coal Company may proceed with the proposed lining of Ponds <br />MB-I and FW-I during December and early January. Mountain Coal Company has indicated that the pond lining <br />project must proceed immediately to mitigate a major landslide now occurring at the West Elk Mine facility area. <br />We are concerned that the pond lining project may be delayed beyond the anticipated time frame due to weather <br />conditions. Please develop alternate water management plans to be implemented if the pond project is not completed <br />by January I5, 1998, and additional abatement extensions cannot be granted. <br />In addition, Mountain Coal Company estimates that the continuation of pumping to the N W Panels sump until <br />January 15, 1998 will introduce about 4 acre-feet of water to the N W Panels sump, snd that the N W Panels sump <br />now holds about 375 acre-feet of water. This additional pumping should not significantly worsen any existing <br />conditions; however, if impacts do worsen, this extension may be reconsidered. <br />Please minimize the pumping to the N W Panels sump during this extension period, to the extent possible, by <br />diverting waters to the surface for required treatment.
