Box 120 <br />Alamosa, Colorado 81101 <br />Re: Nichols Pit - File No. 79-167 <br />Bucky Clanch Pit - File No. 82-33`~ <br />Dear Mr. Malouff: <br />On May 20', 1982, you gave me a request for release of the $1,000.00 financial <br />warranty on the Nichols Pit. Our staff will schedule this pit for an <br />inspection as soon as our general schedule permits. The Act requires that <br />this inspection is done within 60 days of the receipt of the request, and then <br />the Boarcl will act on your request at a regularly scheduled meeting. This <br />action could be approval or denial of the bond release request, depending on <br />the Board's judgment as to the status of the reclamation. <br />l- <br />On April 28, 1982, I sent you copies of our forms for performance and financial <br />warranties for the Nichols Pit. These were fury filled out by me for use with <br />your $1,000.00 certificate of deposit (No. 1721) and require only your notarized <br />siynature to be complete. In order to complete our files, properly warranty <br />this pit, and facilitate the eventual release of your $I ,000.00 certificate <br />of deposit, please sign these forms (having, as I said, each signature notarized) <br />and return them to our Division as soon as possible. <br />Enclosed please find a copy of pages 5 and 6 of the minutes of the May 26, 1982 <br />meeting of the Mined Land Reclamation Board. Agenda Item 7 concerns the recon- <br />sideration of the civil penalty for the Bucky Clanch Pit by the Board during <br />a formal public hearing. 2 feel that these minutes are largely self-explanatory. <br />I will expect to receive a check for $200.00 made out to the State of Colorado <br />in payment of the unsuspended portion of the civil penalty and the $1,000.00 <br />financial warranty and performance warranty for the Bucky Clanch Pit by no later <br />than June 25, 1982 (30 days after the May 26 meeting). <br />
