Eong <br />FROM: Sandy Brown Division Director <br />DATE: November 1, 1 99 <br />RE: NOV CV-99-012 <br />This NOV was issued because Kerr Coal Company went beyond their disturbance <br />boundary. They are in the process of hauling coal debris from their loadout to the mine <br />site. The volume of coal debris was much higher than anticipated and Kerr had to expand <br />the disposal area. Topsoil was wind rowed along most of the expansion area, however <br />there was a small section where topsoil was covered, and the drainage ditch was filled in. <br />The extent was small. I am estimating the disturbance was approximately 50'long and <br />about 3' wide. The drainage ditch was filled, but all runoff would still go into a sediment <br />pond. Kerr had hired a contractor to do [he work, and this happened while Jim Mossman, <br />the Kerr on site supervisor, was gone. <br />No topsoil should be lost as a result of this NOV. Kerr should be able [o recover all of it. <br />In fact, they say [he topsoil has been recovered in the attached letter dated Oct. 28, 1999. <br />Kerr also states that the drainage ditch has been reconstructed. <br />I have not been on-site to see if the NOV has been abated, but according to the attached <br />letter, it has been. <br />
