Lamm <br />Governor <br />December 11, 1984 <br />Mr. Robert Hagen <br />Office of Surface Mining <br />Reclamation and Enforcement <br />219 Central Avenue, NW <br />Albuquerque, New Mexico 87102 <br />RE: Ten Day Notice No. 84-2-244-12 Written to Kerr Coal Company <br />File No. C-003-80. <br />Dear Mr. Hagen: <br />The Division would like to respond to TDN 84-2-244-12 written to Kerr Coal <br />Company for failure to install baffles in the sediment ponds C, D, and F in <br />accordance with the approved permit. <br />On December 7, 1984 Kerr Coal Company submitted a minor revision to the <br />Division requesting that the baffle systems be deleted from the sediment <br />ponds. Kerr Coal's rational is that the baffles are not required to meet <br />effluent standards or design criteria for the sedimentation facilities. <br />The Division is currently in the process of reviewing the minor revision. The <br />Division will make a decision by December 17, 1984 regarding the minor <br />revision. <br />If it is determined that the baffles are not needed to fulfill design <br />standards and meet effluent limitations the revision will be approved and no <br />further action will be taken by the Division. <br />If it is determined that the baffles are required to meet design criteria and <br />effluent limitations, the revision will be denied, the Division will take <br />enforcement action. <br />If you have any questions, please feel free to contact me. <br />Sincerely, <br />Brian E.
