I am not sure <br />if the Courts final judgment has a lot to do with the <br />settlement. Neither this office nor my client was advised that <br />Guffey intended to terminate operations on the property. Having <br />been so advised, a different agreement would have been in order. <br />The settlement at all stages, as demonstrated by the <br />transcript contemplated a sale to Brill for the purpose of <br />permitting him or his purchaser or assignee to continue with the <br />operation. Throughout the proceedings this was represented to <br />us, and constituted one of the overriding considerations. <br />Please explain why you sent over an assignment to sign <br />if reclamation was your client's intent. Please explain why the <br />settlement as dictated to the Court by you indicated there would <br />be an assignment. <br />This would appear to be another instance of your client <br />changing his mind.
