III IIIIIIIIIIIIIIII <br />999 <br />BULL SEEP <br />MEETING MINUTES <br />DECEMBER 19, 2001 9:30 AM <br />(REVISED JANUARY 4, 2002) <br />MINUTES <br />Attendance: (SEE ATTACHED LIST) <br />Location: Urban Drainage & Flood Control District Board Room <br />Time: 9:30 AM <br />Date: Wednesday, December 19, 2001 <br />Meeting Minutes: <br />1. An attendance list was passed around. Bryan Kohlenberg (UD&FCD) and Craig <br />Jacobson (ICON Engineering) mentioned that comments on [he Meeting Minutes <br />from November 28'h had been sent out via email. Jeff Schwarz (Massey Semenoff <br />Schwarz & Bailey, P.C.) and Jessica Barbier requested [ha[ copies of the ll/28 <br />minutes be distributed to them again. <br />2. Jeff Schwarz added that the Mined Lands Reclamation Board met last Wednesday. <br />Jeff mentioned that at this meeting, the Division of Minerals and Geology decided <br />that they did not have sufficient proof that the relocation of Bull Seep caused the May <br />5''' blowout and therefore withdrew their recommendation to [he Mined Lands <br />Reclamation Board to issue a second violation of the tnining permit with respect to <br />the downstream damages in the Bull Seep. Lafarge's position will now be to focus on <br />revising the drainage plan in accordance with the orders from the October hearing. <br />Lafarge had received a time extension, January 11, 2002, from the board to submit <br />the revised plan. <br />3. Jeff continued to add that John Hickman (Lafarge) has been in contact with George <br />McDonald of the Fulton Ditch Company and the Fulton Ditch Board appears to be <br />amenable to the reduction of the Bull Seep flows, upstream of the First Creek <br />confluence, to 50-cfs. <br />4. Jeff began to discuss the current layout of the revised drainage plan. He mentioned <br />that Lafarge proposes to install a pump irrigation system [o feed dewatering flows <br />into [he Bull Seep upstream of the First Creek confluence [o help support the trees in <br />the area. The irrigation will continue in that area until the completion of the mining <br />operation (December 31, 2006) when the ponds are officially turned over to Denver <br />Water. At that time all of the ponds will be lined and the groundwater is expected to <br />return to historic levels. <br />5. Jeff continued to mention [hat a drop structure has been proposed at the confluence <br />between the Bull Seep and Bull Seep Slough. He added [ha[ Lafarge is currently <br />negotiating with Ken McIntosh (McIntosh Farms) regarding the details of an <br />easement on Ken's property. Jeff provided copies of a document identifying two <br />potential easements (Easements A & B). <br />6. Jeff mentioned that Lafarge's objective was to develop a drainage plan addressing the <br />current drainage conditions and that the overflow spillway from Reservoir B would <br />C:\WINDOWS\TEMP\12-19 meeiing.doc <br />
