<br />NOV C-95-024 <br />Bear Mine <br />This NOV was issued for failure to collect and report required hydrology monitoring data <br />from the mine's two alluvial monitoring wells. <br />HISTORY <br />No NOV's have been issued at this mine during the past twelve months. No penalty is <br />assessed for history. <br />SERIOUSNESS <br />Mining related elevation of TDS levels in the alluvial water near the Bear Mine is one of <br />the primary potential impacts which the mine's hydrology monitoring system was designed <br />to detect. Failure to provide this data obstructs the operator's and the Division's ability to <br />assess impacts to the hydrologic balance of the mine area. Since data is only missing for <br />one yeaz, $250 is assessed for a low level of seriousness. The operator should be aware that <br />the Division considers collection of all required monitoring data to be a critical component <br />of their mine permit. <br />FAULT <br />The operator indicated that data missing from reports returned from the lab doing their <br />water analyses was not discovered until it was too late to correct the situation. Regazdless <br />of the operator's inability to correct such omissions under current arrangements with the lab, <br />failure to obtain the required data represents negligence on the operator's part. The <br />operator is responsible for conducting the required monitoring. <br />GOOD FAITH <br />The problem created by the missing monitoring data cannot be corrected. Rapid <br />compliance and extraordinary efforts to abate the violation therefore do not appear relevant. <br />No credit for good faith is given. <br />c:\wp51\121995 <br />
