Banta. <br />Division Direttor <br />I have received your letter of December 3, 1991. I understand that Flatiron <br />Companies requests that the Division not assess a civil penalty regarding this <br />matter. In support of the request, Flatiron relies on Section 5.04.3(2) of <br />the Coal Regulations. This provision states that the Division shall notify <br />the permittee of the amount of proposed civil penalty within 30 days of <br />issuance of the Notice of Violation. The Division apparently notified <br />Flatiron on Day 32. Rule 5.04.3(2)(c) states that failure to be notified of <br />the proposed penalty within the 30 day time span shall not be grounds for <br />dismissal of all or part of the assessment unless the person proves that they <br />have been prejudiced by the delay. The December 3, 1991 correspondence did <br />not allege any prejudice toward Flatirons. Therefore, the proposed penalty <br />should be heard at the assessment conference. Flatirons should note that its <br />rights of appeal under the remainder of Rule 5.04.3 and Rule 5.04.4 remain. <br />Please contact me if you have questions or comments. <br />Sincerely, <br />Steven G.
