Assessment Conference for NOV CV-2004-002 <br />Seneca Coal Company (SCC) has requested an assessment conference for Notice of Violation CV- <br />2004-002 issued to SCC for the Yoast Mine in Routt County. C V-2004-002 was issued on June 30, <br />2004 for significant erosion and gully formation noted in the Armand Draw drainage from Culvert <br />YB-6 to Pond 010, and for sediment clogged culverts YB-6 and YB-1. This violation is very similar <br />in nature to NOV-CV-2003-006 written 11 months prior for the North Pit drainage azea. A brief <br />summary of the regulatory background and violation follows. A detailed description of the violation <br />area is provided in the attached inspection report dated 6/30/04. The assessment conference will be <br />held at the DMG office on Tuesday August 24, 2004 at 1:00 p.m. I am requesting that you attend the <br />meeting and function as the Assessment Officer. <br />Reaulatorv Back rp_ ound <br />The regulations pertaining to the violation area as follows: <br />Rule 4.03.1(4) and 4.03.3(4) -Haul Road and Light-Use Road Drainage <br />Each haul road shall be designed and maintained to have adequate drainage including culverts and <br />bridges. The water control system shall be designed to safely pass peak runoff from a 10-year, 24- <br />hour precipitation event. <br />Light-use roads planned to be used for a period of more than 6 months shall utilize culverts designed <br />to safely pass the 10-yeaz, 24-hour precipitation event or longer as specified by the Division. <br />Culvert YB-6 provides the stream crossing at Armand Draw for the light-use road accessing the <br />North Pit.
