Section 1G, TIS, R83~+, Routt County, Colorado imown as !fcCOy Aggregates. <br />Gle can find nothing in our records to indicate that you 'gave apr+licd 'or or obtained <br />a mining and reclamation perr.~it from the Colorado "fined T~'.r' ^,cla.~tion "oard for <br />this mining operation. A11 mining operations in the State o~' Colorado rt~ust be <br />permitted by the Board under authority of the Colorado '!fined *,and ~~clama Lion Act, <br />Article 32 of Title 3!', C. ^.C. 1973, as amended (1976 less. ',.r~s - ... 7. IOC S) . <br />Several different situations may apply to your operation: (1) If your mining <br />operation r:as perm.,7nently closed down before ,'u1y 1, 1973, you need not apply to us <br />for a permit. (?) If your mining operation is no~v permanently closed down but was <br />in operation after ,July, 1973, there are reclamation requirements which you should <br />discuss with this office, if you were mining sand and gravel, open coal, limestone <br />for construction purposes or quarry aggregate. (3) I_° your operation is interrLittent, <br />seasonal, or continuous during the year and, under any of these conditions, can be <br />considered presently active, or active after June 30, 1976, it must be permitted <br />under the Colorado +Bined Land Reclamation Rct. If your operation is seasonal, this <br />winter would be a convenient time to apply for a permit. <br />If you have a mining and reclamation permit or have applied for one, please se»d us <br />your permit number and the associated crorrect name of your company. IF you have not <br />yet applied, please cronsult the enclosed Rules and Regulations and a regular permit <br />application (112 forms enclosed). <br />Please be advised that the consequences of operating a mine without a permit can <br />be substantial and severe. Our desire is not to harass businesses, or cause economic <br />hardship, but to effectuate compliance with the state reclamation law by all mining <br />operators. Such a law can not be equitable, nor can ere achieve reclamation at aI1 <br />mines, unloss all operators comply. If you need a permit, it clearly w112 be in <br />your best interest, and ours, to apply for a permit as soon as possible. If a <br />
