Box 6999 <br />Colorado Springs, Co. 80934 <br />Dear Mr. Fullerton: <br />copy of the letter that you sent to Senator Ray Powers was forwarded to me. <br />spoke with Senator Powers and he asked me to respond to you directly. <br />I understand your concern regarding the mining operation proposed by Castle <br />Concrete Company. So that you have a better understanding of the Mined Land <br />Reclamation Board and Division and its responsibility, I have enclosed a copy <br />of our annual report. The one point that I must emphasize is that the Mined <br />Land Reclamation Board does not have the authority to make a decision as to <br />whether a mining operation should be approved based upon its compatibility <br />with surrounding land uses and local zoning. That authority rests with the <br />local government. The Mined Land Reclamation Board determines whether the <br />mining and reclamation plans submitted by the applicant demonstrate that the <br />mining operator will be able to comply with the Colorado Mined Reclamation <br />Act. The essence of that Act requires that the mining operation be conducted <br />in an environmentally sound manner and that the mined land is reclaimed. <br />For your information, there will be a hearing held by the Mined Land <br />Reclamation Board on June 21, 1989 to determine whether approval should be <br />granted to Castle Concrete to mine the additional area requested for the <br />Snyder Quarry. That hearing is scheduled to be held in Denver at 1313 Sherman <br />St. in Room 220. If you have any questions, you can call our office and speak <br />to Bruce Humphries or Dan Hernandez.
