Dept. of Wawral Resources <br />Re: Eastside Coal Company, Inc. <br />Harvey Gap Exploration Project <br />CMLRD NOV No. 83-34 <br />Request for Modification <br />Dear Mr. Shelton: <br />Eastside Coal Company, through its attorneys,- <br />Delaney 5 Balcomb, P.C., request that your agency modify the <br />above-captioned NOV which was issued on December 15, 1983, <br />following a CMLRD inspection on December 12, 1963. <br />Specifically, Eastside Coal Company requests that <br />this NOV be modified in the following manner: <br />1. Third paragraph, page 1 - "cessation of <br />mining is expressly, or in practical effect, required by <br />this notice.": This statement, as originally marked by Mike <br />Savage, the CMLRD Inspector, does not precisely follow his <br />verbal statements to Steve Self of Eastside Coal Company on <br />December 15, 1983, and the handwritten statement under the <br />section titled, "Portion of the Operation to which This <br />Notice Applies", found on page 3 of this NOV. It is East- <br />side Coal Company's express understanding from Mr. Savage's <br />above referenced verbal and written statements and my own <br />telephone conversations with Dan Mathews of your staff that <br />this NOV does not explicitly or implicitly prohibit extraction <br />of the coal from the underground workings at the Harvey Gap <br />Exploration Project site. It is our understanding that the <br />NOV sought to limit only transportation of the extracted <br />coal from this site prior to Eastside Coal Company's com- <br />pliance with Stipulation 1 as written in its Exploration <br />Application Approval No. CX-186-00. <br />
