31. Map Figures 2.2-8 through 2.2-12 was properly deleted, as the subject road was <br />never constructed and is no longer proposed. The list of figures was properly <br />updated. Item resolved. <br />32. Additional Figures 2.2-12.11 through 2.2-12.34, pursuant to the haul road that was <br />never constructed and is no longer proposed, were properly deleted from the permit. <br />Item resolved. <br />33. Figures 2.2-13, 2.2-14, 2.3-1, 2.3-2, and 2.3-3, depict mine facilities that were <br />never constructed and are no longer proposed. The figures were properly deleted <br />from the permit. Item resolved. <br />34. Figures 2.2-16 through 2.2-24 present designs for the Munger Canyon Haul Road <br />that was never constructed and is no longer proposed. The Figures were properly <br />deleted from the permit. Item resolved. <br />35. Figure 2.3-4 was properly amended to accurately depict existing access road culvert <br />locations and culvert dimensions. Item resolved. <br />36. Figure 2.3-5 was properly amended to accurately portray hydrologic monitoring site <br />locations. Item resolved. <br />37. Outdated reclamation plan Map 3.1-1 was properly deleted from the permit. Item <br />resolved. <br />38. Operator adequately responded to a Division question pertaining to delineation of <br />reclamation disturbance limit and operational disturbance limit. Item resolved. <br />39. Operator has not yet substantively responded to a Division request to update Figure <br />3.1-4, because the original figure had not been located. Amendments to Figure 3.1- <br />4 as originally requested in RN-4 Adequacy Item 39 have not yet been provided and <br />the original adequacy item remains unresolved. Please provide an appropriately <br />amended Figure 3.1-4. <br />40. Operator has not yet substantively responded to a Division request to update Figures <br />3.1-5 through 3.1-7, to accurately depict the extent of coal backfill on the mine <br />bench and to depict water bars along the proposed livestock trail, because the <br />original figures had not been located. Please provide appropriately amended Figures <br />3.1-5 through 3.1-7, as originally requested. <br />41. The Division had requested certain modifications to Figure 3.1-8 Haul Road Stability <br />Cross Sections, to eliminate or modify the relatively wide benches depicted on the <br />upper road reclaimed cross-sections. Operator responded that text had been <br />amended for claritication, but that the terraces or benches were integral to the <br />stability demonstration for the steep reclaimed slopes along the upper road segment, <br />and were in compliance with the applicable criteria of 4.03.2(7)(a). The operator's <br />response appears to be acceptable, however the amended page 3-8 was apparently <br />erroneously omitted from the submittal. Please provide the amended page 3-8. <br />42. Operator has not yet substantively responded to a Division request to update Figure <br />3.1-9 (Munger Mine Site Rec/amation Stabi/ity Cross Sections) to accurately depict <br />the extent and configuration of coal backfill, and to update the stability information <br />to reflect the additional coal material, because the original figures had not yet been <br />6 <br />
