certified as an access road; prior to coal waste haulage associated with the recently <br />approved waste disposal site, the segment of road between the refuse disposal site <br />and the State Highway will need to be certified as a haul road. <br />c) Amended text in Subsection 2.2.7 erroneously indicates that Loma Loadout <br />reclamation was completed in April 2002. Our records indicate the work was <br />actually performed in the fall of 2001. Please amend the text as appropriate. <br />The Division requested that outdated drainage control information in Subsections <br />2.3.1 and 2.3.4 be properly amended. Item resolved. <br />The Division requested that outdated topsoil management information contained in <br />Section 2.4 be properly amended. Item resolved. <br />The Division requested that Subsection 2.2.5 pertaining to disposal of coal mine <br />waste be properly amended upon approval of TR-14, which was under review at the <br />time the adequacy letter was written. The TR-14 updates were previously <br />incorporated, and the identical narrative of Subsection 2.2.5 has been included in <br />the TR-16 submittal. Item resolved. <br />In RN-4 Adequacy Items f0 through 19, the Division had requested numerous amendments <br />to update and clarify current reclamation plan provisions in Section 3.0 Reclamation Plan, <br />and delete outdated provisions. In the response submittal cover letter for TR-16, the <br />applicant stated that Section 3.0 had been re-written in its entirety, and indicated that <br />current permit pages 3-1 through 3-35 should be removed and replaced with revised pages <br />3-1 through 3-21. <br />10. The Division requested that outdated narrative in the introduction to Section 3.0 be <br />properly updated or deleted. The section was in general properly updated, however <br />there appear to be certain inconsistencies that need tc be resolved or further <br />explained: <br />a) The initial paragraph references planting of live stock of woody plants, but this <br />may be mis-leading because the amended revegetation plan does not include <br />planting of woody stock. Woody species included in the amended seedmix have <br />been successfully established from seed on reclaimed areas in similar environments. <br />The wording of the paragraph should be properly amended. <br />b) The reference to portions of roads that will be reclaimed is somewhat confusing. <br />Please amend the wording to clarify that the upper segment of the road will be fully <br />reclaimed, while the lower segment will be modified and retained for the post mining <br />land use, as described in Subsections 3.3.1 and 3.3.2. <br />11. The Division requested updates to narrative in Subsection 3.1-1, and elimination of <br />outdated Figure 3.1-1. Item Resolved. <br />12. Text in Subsection 3.2 (Introduction), 3.2.1, and 3.2.2 was updated as requested. <br />Item resolved. <br />13. Text in Subsection 3.2.3 was properly updated and Figure 2.2-9 was deleted as <br />requested. Item resolved. <br />
