Loc hhead <br />Eaec ulive Director <br />RE: Smith Pit II (File No. M-94-074) Adequacy review of 111 p~;,,~„`°nR <br />ecbr <br />application <br />Dear Mr. McDonald: <br />I have reviewed the application referenced above and have <br />identified the following adequacy concerns: <br />EXHIBIT C: Reclamation of the pit is indicated not to occur <br />until the fall of 1995. Topsoil salvaged prior to excavation <br />of the gravel beginning in 1994 will, as a result, be <br />stockpiled until that time which is over a year or one growing <br />season. There is no commitment made in the application to <br />stabilize the topsoil stockpile with vegetation for this <br />period of time in order to protect this resource from erosion <br />and loss. <br />0~ <br />Please commit to stabilize the topsoil stockpile with <br />vegetation until its use in reclaiming the pit by seeding it <br />in the fall of 1994 and indicate what seed mix is to be used <br />in this stabilization. <br />EXHIBIT C: The application indicates that the asphalt batch <br />plant is to be located within the adjacent permit area for the <br />Lyle Smith Pit (Permit M-77-053). Review of the permit <br />package for the Lyle Smith Pit indicates that such a facility <br />was never approved for that pit. <br />Please indicate if this plant is entirely portable. If it is, <br />then you should immediately submit a technical revision to the <br />6,~ permit of the Lyle Smith Pit proposing the installation of a <br />portable asphalt batch plant within the permit area. If there <br />are no environmental or reclamation concerns associated with <br />installation of such a facility, the Division should have <br />little difficulty in approving the revision and would do so <br />expeditiously. If, however, the plant is not entirely <br />portable, you will also have to propose a technical revision <br />to the permit of the.Lyle Smith Pit but you must describe the <br />plant in detail, revise your reclamation plan to include its <br />removal, and provide for its removal in your reclamation bond. <br />
