!:~
b. No plans. Castle has proposed no plans or design far the
desiltation pond which makes it impossible to evaluate or approve at this
time.
10. Anchoring Boulders.
a. In Areas 5, 6, and 7, Castle proposes stockpiling limestone
sanding chips along the roadside for future use. These chips should be
stockpiled in the mine permit area and not along the road. Becau~;e of
the adjacent steep slopes and the large number of trucks rumbling by,
there is a significant risk that these materials will eventuallly slide
down the hill.
b. Castle also proposes placing large boulders "along the top
backside of the stockpile areas to act as a barrier keeping the chips
from being accidentally spilled." With Castle's experience of
"accidentally" causing off-site rockslides, these boulders, if used,
should be anchored in holes.
11. Corrective Action Plan Boundaries. For every disturbed area,
Castle proposes a CAP boundary well beyond the boundary of the dis~~turbed
area. In at least two areas, these boundaries will be on property owned
by Cedar Heights. The CAP boundary should, as nearly as possible,
coincide with the disturbed area boundary.
WHEREFORE, the Cedar Heights Lenders respectfully request that the
Board defer from approving the CAP until each of these problems are
resolved.
Respectfully submitted;
SPARKS, DIX, ENOCH & WINSLOW, P.C.
~''''~
.
