Mr. Dan Hernandez
October 19, 1989
Page 3
Finally, if Castle is unsuccessful in correcting the
disturbances it caused or if Castle disturbs those areas again,
such a situation may establish another violation. If the permit
area is extended to the present disturbed areas, future dumping or
rockslides in those areas ostensibly might not be violations. For
this final reason, Lenders also think it is inappropriate to extend
the permit area to the corrective action areas.
If you have any questions about this matter or if the
Lenders can be of any service in developing the best possible
corrective action plan, do not hesitate to call me or the Lenders'
geotechnical expert, John Himmelreich. Mr. Himmelreich's number is
(719) 528-1331.
Sincerely yours,
SPARKS, DIX, ENOCH
$ WINSLOW, P.C.
L. Martin Nussbaum
LMN/ajr
cc: Jean Hyde
Aubrey C.
