I. PROCEDURE FOR SEEKING BOND RELEASE AND SUMMARY OF THE <br />REVIEW PROCESS <br />This document presents the results of the Colorado Division of Minerals and Geology <br />(DMG) review of a request from the Kerr Coal Company for a, Phase I release of the <br />reclamation bond applicable to the 720 Pit at the Man Strip Mine for successful <br />completion of backfilling, regrading and drainage control in accordance with the <br />approved reclamation plan. In January 1994, Kerr Coal Company completed bacld'illing, <br />regrading and drainage control measures for the major mining disturbance areas. Kerr <br />Coal Company applied for a Phase I bond release on April 18, 1994, under Rule 3.03.2 <br />of the Regulations of the Colorado Mined Land Reclamation Board for Coal Mining. <br />The Marr Strip Mine is located approximately 10 miles east of Walden, Colorado on <br />County Road 12. The bond release request covers the 720 Pit areas within the mine <br />permit boundary located in section 35, T 9 N, R 78 W and in section 2, T 8 N, R 78 W, <br />both of the 6th Principal Meridian. The mine site is located on the U.S.G.S. 7.5 minute <br />quadrangle maps titled "Johnny Moore Mountain" and "Gould NW". <br />Kerr Coal Company, the permittee, owner and operator of the Marr Strip Mine, <br />originally submitted their Phase I request to include the Pit 1 and 720 Pit areas. The <br />original application for Phase I bond release was received by the DMG on March 18, <br />1994. The required public notice was published for four weeks in the Jackson County <br />Star between March 17, 1994 and April 7, 1994. The Affidavit of Publication was <br />received by the DMG on April 18, 1994. The application was deemed complete on <br />April 21, 1994. The DMG scheduled and conducted a Phase I bond release inspection <br />on May 12, 1994. <br />A Phase I inspection of both the Pit 1 and 720 Pi[ areas was conducted on May 12, 1994 <br />in accordance with Rule 3.03.2(2). Present at the May 12, 1994 inspection were <br />representatives of Kerr Coal Company, permittee and landowner; U.S. Dept. of Interior, <br />Office of Surface Mining (OSM); U.S. Dept. of Interior, Bureau of Land Management <br />(BLM), landowner; Colorado State Land Board, landowner; and DMG. <br />Concerns identified at the May 12, 1994 inspection, resulted in additional reclamation <br />activities at both the 720 Pit and Pit 1 areas. In May 1995, Kerr Coal Company <br />completed all additional reclamation requirements for the 720 Pit area and subsequently <br />modified their April 18, 1994 Phase I request to include only the 720 Pit area. The <br />DMG scheduled and conducted a second bond release inspection for the 720 Pit area on <br />June 5, 1995. The second Phase I inspection was conducted in accordance with Rule <br />3.03.2(2). Representatives of Kerr Coal Company and DMG were present. Kerr Coal <br />Company is the landowner of the lands included under this bond release. <br />
