<• <br />NOV C-98-003 <br />Trapper Mine <br />This NOV was issued for failure to treat surface runoff to meet effluent limits, failure to maintain <br />adequate freeboard of a sediment pond embankment and, failure to provide a pond discharge <br />strutture which safely passes storm runoff. <br />HISTORY <br />No NOV's have been issued at this site during the past twelve months. No penalty is azsessed <br />for history. <br />SERIOUSNESS <br />Damage from the problems cited in this NOV appears to have been minimal. There is no <br />evidence that the non-compliant pond discharges had any observable impact on receiving <br />streams. Damage to the pond embankment where the required freeboard waz not maintained <br />waz characterized az insignificant by the DMG inspettor. The erosion resulting from discharge <br />at the third pond cited in the NOV (NO Name #5) was apparently limited to a small area. $250 <br />is assessed for a low degree of seriousness due to the minimal impacts observed. <br />FAULT <br />The operator submitted information indicating that the problems cited in the NOV resulted <br />from an unusually rapid snow melt. Based on the occurrence of nearby flooding and <br />temperature records, this would certainly appear to be the case. However, there is no <br />information indicating that the runoff volumes at the mine were in excess of storm runoff <br />volumes which are required by regulations and the mine permit to be treated and safely <br />discharged. Consequently, $250 is azsessed for a minimal amount of negligence. <br />GOOD FAITH <br />The NOV haz not been abated at this time. Therefore, good faith is not relevant at this time. <br />042198 <br />
