Conclusion <br />The counties in the State of Colorado receive an exemption from the <br />payment of permit application fees and the requirement of posting <br />acceptable financial warranties under section 34-32-111(7) of the <br />MLRA and section 34-32.5-111(6) of the Act when the purpose of the <br />permit is for construction of public roads. <br />However, the requirement to pay annual fees by counties has not <br />been waived by the General Assembly in ~ 34-32-111(7), C.R.S. or <br />~ 34-32.5-111(6), C.R.S. Counties, as operators of construction <br />materials (sand and gravel) mines for the purpose of constructing <br />public roads, like other minerals reclamation permittees who <br />qualify under that section of the Construction Materials Act for a <br />section 111 permit, are required to pay the $625 annual fee <br />established in § 34-32.5-125, C.R.S. Finally, this fee applies to <br />all existing and future county section 111 permits. See ~ 34-32.5- <br />109, C.R.S. <br />
