This is grounds for sporting the FUIT. MSXII~?Ut4 <br />FLUE that the Mined Land Reclamation Board can levy ~ MG for <br />this violation, C° 3~ 1; o00 ,~-- ~ ,b. b o ~~ <br />" 2) The Conservancy District will be requesting INDLPEVDFN:~ SAi4PI.I:7G <br />of the ponds, tailings, and all other sampling imposed a result <br />of this. Bi'4G has by, this serious violation, indicated t~-iat it is <br />not prepared to act in a responsible manner toward the II.RD and <br />this co:rmunity, ..fi ~i+/t, ~n,~,.._e , <br />"3) The Mined land Reclamation Board should absolutely NOT ~NSFNL' TO <br />A C:iAVGE LEI STADIDARD ESfABLISI-IED at the ti.ire of permit ssuance. <br />"4) A clean-up of ponds and tailings storage should be initiated to <br />preclude the creation of a TO.~C, 3PZ~'1RDOilS WASTE STI'B. <br />"5) The long-term problem of heavy metal should be studied y scientists <br />and technicians i~rmediately. If necessary, action shoal be <br />initiated to maintain the site safety. <br />"6) The containment dam should be examined and assure that has been <br />professiaially designed to avoid tailing spillage and c tamination <br />as a result,.during "normal" times from all negative ca es <br />including erosion, tailing pressure, etc. <br />"7) In the event ffi?G is found in violation once= again, P~ should <br />revoke the permit to operate, perm~iently. <br />"8) &'1G should meet all the above requirements before being allowed to <br />continue operation. <br />Whereas the Board of Costilla County Commissioners is in fu~l accord <br />
