We have enclosed <br />a check to cover the civil penalty amount for these violations. <br />I was unsure as to whether the other settlement agreements needed <br />to be returned to you unsigned in order to request a Board Hearing <br />or if their absence was good enough. If you need them please give <br />me a call and I will get them in the mail to you. <br />P&M is requesting a hearing before the Colorado Mined Land <br />Reclamation Board regarding Notices of Violation C-023-93, C-024-93 <br />and C-026-93. we would prefer these matters go before the Board in <br />either July or August of this year. It is my understanding that <br />the Board convenes once a month. 2 also understand that the DMG <br />will now assess us a civil penalty to be held in escrow pending <br />outcome of the subject Notices. If this amount is the amount <br />proposed in the Settlement Agreements, please give me a call and I <br />will have the checks cut and sent to the DMG. <br />Please give me a call at your convenience, to discuss some of these <br />matters that I am unclear about. <br />Sincerely, <br />~~ <br />David L.
