<br />-2- <br /> <br />Cease and Desist from conducting any further mining activities at the <br />Tripple R Pit - Permit M-91-097; until an adequate, properly executed <br />financial warranty has been provided to the Division. <br />2. Mail, within one (1) day after receipt of this Notice, to the Mined Land <br />Reclamation Board, written notice of your compliance with paragraph one <br />(1) of this Cease and Desist Order. <br />3. Complete the following corrective action: <br />a. Relocate the stockpiled topsoil adjacent to the west pit wall, and <br />regrade the four pit walls to a minimum slope of 2:1 by <br />September 20, 1994. The east and south pit walls will require <br />backfilling in order to minimize any potential damage to the <br />overhead powerlines and the irrigation ditch. <br />b. Submit an adequate, properly executed financial warranty no later <br />than October 6, 1994 in the amount of which will be determined at <br />the September 21-22 Board Meeting. <br />4. Pay the Colorado Mined Land Reclamation Board a civil penalty to be <br />determined at the September 21-22 Board Meeting, payable within 15 days. <br />This Cease and Desist Order shall remain in effect until all terms have been <br />satisfied by the operator. <br />In clarification of the rights of recipients of Notices of Violation, Cease <br />and Desist Orders, parties are advised to consult the Colorado Mined Land <br />Reclamation Act and the State Administrative Procedure Act. <br />Nothing herein contained, particularly those portions requiring certain acts <br />to be performed within a certain time, shall be construed as a permit or <br />license to engage in any prospecting or mining operations within the State. <br />Persons concerned with judicial review of the provisions of this Order are <br />advised to consult C.R.S. 24-4-106, as amended. <br />Dated at Denver this ~ day of ~~ I. <br />COLORADO MINED LAND RECLAMATION BOARD <br />DEPARTMENT OF NATURAL RESOURCES <br />L.-rl ~ Tt <br />MI AEL B.
