Dept. of Pdatural Reso!~rce° <br />Dear Mr. Herron: <br />This is in regard to your telephone conversations of July 12, 1982, and <br />August 6, 1982, with Julie Euchner concerning clarification of the cultural <br />resource stipulations for the Powderhorn Coal Company Mine Plan Permit <br />application. <br />The stipulation in question, Number 1 on Page 8 of the Unsuitability <br />Report, reads as follows: "Where underground mining is to take place, <br />monitoring by a qualified archeologist for degree of subsidence will be <br />done every six months. Special attention will be given to areas where <br />known archeological resources are present. If subsidence is determined <br />to be affecting cultural resources, the BI,M Area Manager will be notified <br />and appropriate measures will be taken in consultation with the State <br />Historic Preservation Officer to mitigate its effect." <br />The intention of this stipulation is to safeguard known areas of fragile <br />archeological resources from the potential impact of subsidence, an <br />occurrence which is hard to predict in exact location and severity. <br />However, comments received both from your office and that of Powderhorn <br />Coal Co. indicate that this stipulation would be difficult to implement <br />logistically and that it is in excess of what is needed for site protection. <br />Therefore, Stipulation Number 1 is now changed to read: <br />"Where underground mining is to take place, monitoring for impact <br />to known site locations will be required in those areas where <br />subsidence has been determined to be occurring, or where there is <br />a possibility that it may be occurring. A11 monitoring of sites <br />is to be carried out by a qualified archeologist. If subsidence <br />is determined to be affecting cultural resources, the BLM Area <br />Manager will be notified and appropriate measures will be taken <br />in consultation with the State Historic Preservation Officer to <br />mitigate its effect." <br />
