NOTIFICATION OF INTENT TO SEEK BOND RELEASE <br />PROPOSED PUBLIC NOTICE <br />Kerr Coal Company (Kerr) has filed an application with the Colorado Division of Mmerak and <br />Geology (DMG) for partial release of the existing reclamation sttrety bond for the Marr Mme (IvLne) <br />and Kerr Loadout (Loadout). Kerr u the owner, operator, and permittee tinder Permit No. G80-006 <br />for the Mme and Loadout. The Mine is located approximatelyten miles east of Walden, Colorado on <br />County Road 12 and the Loadout is located on the south edge of Walden adjacent to the Illinois River <br />and the former Louisiana-Pacific lumber mill. Box 487 <br /> Walden, Colorado 80480 <br /> (970) 723-4721 <br />The partial bond release request covers areas within the Mme and Loadout permit boundaries which <br />encompass the following specific areas: <br />Township 8N, Range 78W, 6~ Principal Meridian -Section 2 <br />Township 9N, Range 78W, 6~h Principal - <br />Sections 22, 23, 25, 26, 27 and 35 <br />Township 9N, Range 79W, 6~ Principal Meridian -Sections 28 and 29 <br />These areas are shown on the Johnny Moore Mountain, Gould NW, Walden, and Eagle Ifill 7.5 <br />minute USGS Quadrangle Maps. <br />The Mute operated from 1974 through eazly 1993 under an approved pemut from the DMG. The <br />current mine permit was originally approved and issued on Mazch 20, 1981 and was subsequently <br />renewed on July 22, 1986, December 9, 1992, and May 15, 1996. The Marc Mine ceased active <br />operations in January 1993 and Kerr subsequently completed backfilling, grading, constmction of <br />postnainutg drainage control features, topsoil replacement, and persnanent revegetation seeding during <br />the period from 1993 through 1996 for the two remaining active mine pits, the 720 Pit and Pit 1, and <br />the associated overburden stockpile area. Kerr applied for and obtained DMG approval of a Phase I <br />partial bond release for completion of backfilling, grading, and drainage control activities for these <br />auras in 1995/1996. Kerr is requesting approval of a 25 percent Phase II partial bond release for <br />these areas for reestablishment of vegetation [o support the approved postmining land use and <br />restoration of adequate vegetative cover consistent with the approved revegetation success standards. <br />The separate coal loadout facility, which served the mine during active operations, was idled when the <br />mine shut down in 1993 and remairted idle while Kerr explored alternative uses for the loadout area <br />and associated facilities. When reasonable options for alternative toes were exhausted, Kerr <br />completed reclamation of loadout area in 1999 with facility removal, backfilling and grading, soil <br />material replacement, and pemtanent revegetation seeding. Kerr is requesting approval of a 60 <br />percent Phase I partial bond release for completion of final backfilling, grading, and drainage control <br />in the Kerr Loadout Area. <br />Approval of the requested Phase I and Phase II partial bond releases will leave a bond balance of <br />5687,467. Rer*~~~~~ng mine disturbance areas that have not been reclaimed include a total of 42.7 <br />acres including 37.9 acres associated with remaining facilities, roads, drainage and sediment control <br />stmctures, and topsoil stockpiles in the Mine Area and 4.8 acres associated with rema+~i~g facilities, <br />roads, drainage and sediment control structures m the Loadout Area. Kerr has received DMG <br />
