SAMPLE NOTIFICATION LETTER <br />INTENT TO SEEK BOND RELEASE <br />September 15, 2000 <br />United States of America <br />Bureau of Land Management <br />Colorado State Office <br />1600 Broadway -Room 700 <br />Denver, Colorado 80202 <br />Re: Kerr Coal Company - Marr Mine, Notification of Intent to Seek Bond Release <br />Deaz <br />Kerr Coal Company (Kerr) is the owner and operator of the Marc Mine and associated Kerr <br />Loadout Facility The Kerr Mme area u located approximately 10 miles east of Walden on County <br />Road 12 and the Loadout area is located on the south edge of Walden adjacent to the Illinois River <br />and the former Louisiana-Pacific lumber mill. <br />Kerr ceased active rnining operations in early 1993 and subsequently proceeded with reclamation <br />of tnining disturbance and the loadout facility Reclamation of active mine areas was completed in <br />1996 and reclamation of the loadout facility was completed in 1999. The State of Colorado, <br />through the Colorado Department of Natural Resources (DNR), currently holds a reclamation <br />bond as surety for final reclatrtation of all mining and related disturbance areas associated with <br />Ketr's mining operations. <br />Consistent with applicable regulatory provisions, Kerr has filed an application with the Colorado <br />Division of Minerak & Geology (DMG) requesting partial release of those bond amounts <br />associated with the required reclamation work that has been completed to date. The partial bond <br />release request includes a Phase I partial bond release for the Kerr Loadout Area for completion of <br />backfilling, grading, and drainage control activities, and a Phase II partial bond release for the 720 <br />Pit and Pit 1 areas of the Marr Mme Area for reestablishment of an effective vegetative cover. <br />As an interested or potentially affected landowner or governmental entity, you have opporttmity to <br />access the proposed bond release areas and/or provide comments for the DMG's consideration in <br />making a determination on Kerr's partial bond release request. If you have questions regarding <br />Kea's partial bond release request or wish to access the subject areas you may either contact Kerr <br />directly or may contact the DMG. If you have concerts or objections regarding this issue, you <br />should contact the DMG directly and tnay wish to provide written commenu or objections for the <br />DMG's consideration.
