Long <br />D~~~,~nn D~rrri~~r <br />Per your request I reviewed permit materials on file at the <br />Garfield County Courthouse on May 21, 1996. Materials I reviewed <br />included Technical Revision No. 12 (Bond Release Issues), the <br />November, 1992, Findings Document, the 1994 and 1995 Annual <br />Reclamation Reports, recent Division inspection reports, and the <br />permit application package. I also conducted a field inspection. <br />My review focused on compliance with Rules 2.04.9, 2.04.10, <br />2.04.12, 2.05.3(4), and 2.05.4(2)(e). I identified no concerns <br />with respect to soils resource information, prime farmland <br />investigation, or topsoil removal and storage. The only concern I <br />have with respect to topsoil replacement is in regard to the small <br />pile (probably 50 cubic yards) of topsoil which remains on the <br />upper portion of the reclaimed east portal bench slope, mentioned <br />in recent inspections. This soil material needs to be properly <br />graded to blend in with the adjacent terrain, seeded, and mulched. <br />I do have several concerns related to revegetation and the <br />postmining land use. These concerns are listed below. <br />Please let me know if you have any questions. <br />1. Rule 2.05.4(2)(e)(v) requires a description of "irrigation, if <br />appropriate and pest and disease control measures, if any." <br />Various sections of the permit application indicate that the lower <br />portion of the reclaimed area below the terraces was seeded with an <br />irrigated hayland mix and would be managed as irrigated cropland. <br />However there is no discussion of proposed irrigation and cropping <br />management for the area, and at the time of my inspection the area <br />was not being irrigated and apparently had not been irrigated this <br />spring. Page 4-57 of the application indicates that "the operator <br />initially planned to irrigate the dryland area late in 1995 to <br />assist in vegetation establishment", but because of the wet spring <br />
