(BMRI) hereby <br />withdraws Technical Revision (TR) 28 for the San Luigi Project. As referenced in Mr. Bruce T. <br />Marshall, of Rocky Mountain Consultants, Inc.'s, correspondence dated April 20, 2000 to Ms. <br />Lori Potter, "The West Pit Water Management Systa~n has not operated througkt a complete <br />hydrologic cycle, nor has the in-situ remodiat;on systertr been tested. Therefore, we believe it is <br />premature for the Division of Minerals and Geolog)~ (DMG) to have requested that BMRI <br />develop such a plan" (see page 1, paragraph 2, second and third sentences). BMRI agrees with <br />Mr. Marshall's conclusion that the plan is premature aadl, therefore, withdraws TR-28. <br />As BMRI committed to is TR-26, BMRI will "subtr1'it a detailed plan for post-closure water <br />quality monitoring in the alluvial system" at a later date as drrected by the Division. It is and has <br />always been BM12I's intention to develop a realistic and protective long term monitoring <br />program for the Rito Seco alluvial and West Pit hydro) gical systems.
