C-89-021 <br />Dear Randy: <br />This letter is a request for extension to remedy the violation C- <br />89-021 concerning the ditches on the site which have resulted in <br />erosion. The extension is requested for the following reasons: <br />(1) The ditches have been designed for the 100 year 24 hour <br />runoff event. These designs will be submitted to the Division on <br />- November 20, 1989. It is preferred that the Division review these <br />designs prior to implementation. <br />(2) The work done at the south end of the coal stockpile is <br />completed. <br />(3) Certain portions of the ditches requested to be remedied will <br />be removed for final reclamation. <br />(4) The revised application will be submitted on November 20, <br />which includes all responses to the recent adequacy review. If <br />approval can be granted quickly, the work on final reclamation <br />will begin the very next day after approval. <br />(5) American Shield commits to performing the remaining remedial <br />measures on the violation at the very start of the final <br />reclamation process. If all goes according to schedule, the work <br />will be performed in December of this year. <br />(6) There is not a great chance of an erosion-causing storm at <br />this time of year on the site. <br />
