., <br />State Rule 4.20.2, which requires underground coal mining <br />operations to notify landowners six months before their land is <br />undermined. DMG further asserted, however, that it had issued a <br />Notice of Violation (NOV) to Basin for violating State Rule <br />4.20.2 on August 13, 1993, and that Basin had taken corrective <br />action, causing the NOV to be terminated on November 11, 1993. <br />DMG asserted that Basin had not violated the other portions of <br />State Rule 4.20, as alleged in the TDN. Finally, DMG stated that <br />Basin had not violated State Rule 2.05.3(2) as alleged in <br />violation 3 of 3 of the TDN. See AR III-26. <br />4. By letter dated February 4, 1994, after receiving <br />additional information from DMG by letters dated January 19 and <br />21, 1994, OSM-AFO responded to DMG that it found its response to <br />TDN No. 93-020-370-005, violations 1 and 3 of 3 to be <br />"appropriate" pursuant to 30 C.F.R. § 842.11. See letter to <br />Steven Renner dated February 4, 1994, attached hereto as Exhibit <br />B. <br />5. By letter dated February 4, 1994, OSM-AFO also informed <br />the Appellant that it found the State response to TDN No. 93-020- <br />370-005, violations 1 and 3 of 3 to be "appropriate" pursuant to <br />30 C.F.R. ~ 842.11. OSM-AFO informed the Appellant that no <br />further action would be taken by OSM-AFO in response to the <br />Appellant's allegations. OSM-AFO also informed the Appellant of <br />the right to request informal review of OSM-AFO's decision <br />4 <br />
