fail, promptly repair or replace the damaged structures or
compensate the owners of the structures.
As has been exhaustively shown under part II of this answer,
from January 1995 through September 1995, OSM and DMG Conducted a
thorough investigation into the possibility that subsidence had
damaged the Tatum home. OSM and DMG experts visited the Tatum
property on February 1, 1995 (AR III-3), May 11, 1995 (AR II-20),
and May 19, 1995 (AR II-13). The May 19, 1995, visit included
OSM subsidence expert, Dr. Jesse Craft. All of the OSM and DMG
experts agreed, in separate written reports, that subsidence was
not causing the damage to the Tatum house. See the following
reports: Jim Pendleton, February 8, 1995 (AR III-3); Mike
Rosenthal, February 16, 1995 (AR III-5); Jesse Craft, June 30,
1995 (AR II-1); and, Kewal Kohli, July 17, 1995 (AR I-27).
In addition, the OSM and DMG experts noted that several
factors other than subsidence were likely causes of the damage to
the Tatum house including poor roof design, dewatering of the
area near the house by trees, rotting tree roots under the
house's foundation, and the aging of the concrete stucco finish
on the exterior of the house.'
See the Jim Pendleton memorandum of May 22, 1995 (AR II-
16), the Jesse Craft report of June 30, 1995 (AR II-1), and
the Jim Pendleton memorandum of June 2, 1995 (AR II-8).
34
