6. The .State regulations for a required subsidence
monitoring program as called for in Rule 2.05 6(C)Z
were not followed.
7. No subsidence control plan was submitted.
8. No periodic or any other survey monitoring was done
of the damaged structures and water well and none
continues to be done to this date.
*f+
10. I fail to see that our water well and buildings
were listed on the subsidence inventories at the Golden
Eagle (Maxwell) or New Elk (Allen) mines.
See AR III-29.
2. OSM's TDN
Based on the information in the citizen's complaint, it
would appear that Basin had violated several permitting
requirements and performance standards of the State program
concerning subsidence control. Accordingly, OSM-AFO issued TDN
number 93-020-370-000, violations 1 and 3 of 3 to address these
allegations (AR III-28). The TDN included the following specific
alleged violations by Basin:
[Violation 1 of 3: State Rules 2.05.6(6) and 4.20]
Failure to properly conduct a subsidence survey,
subsidence monitoring, and a subsidence control plan.
Jim Tatum property. (Includes subsidence inventory of
structures) .
[Violation 3 of 3: State Rule 2.05.3(2)]
Z This appears to be a typographical error as no such rule
exists. The Appellant is probably referring to State Rule
2.05.6(6}(c).
21
