6. The .State regulations for a required subsidence <br />monitoring program as called for in Rule 2.05 6(C)Z <br />were not followed. <br />7. No subsidence control plan was submitted. <br />8. No periodic or any other survey monitoring was done <br />of the damaged structures and water well and none <br />continues to be done to this date. <br />*f+ <br />10. I fail to see that our water well and buildings <br />were listed on the subsidence inventories at the Golden <br />Eagle (Maxwell) or New Elk (Allen) mines. <br />See AR III-29. <br />2. OSM's TDN <br />Based on the information in the citizen's complaint, it <br />would appear that Basin had violated several permitting <br />requirements and performance standards of the State program <br />concerning subsidence control. Accordingly, OSM-AFO issued TDN <br />number 93-020-370-000, violations 1 and 3 of 3 to address these <br />allegations (AR III-28). The TDN included the following specific <br />alleged violations by Basin: <br />[Violation 1 of 3: State Rules 2.05.6(6) and 4.20] <br />Failure to properly conduct a subsidence survey, <br />subsidence monitoring, and a subsidence control plan. <br />Jim Tatum property.
