25. By letter dated August 23, 1995, Susan McCannon, Coal <br />Program Supervisor for DMG, informed Ms. Ann Tatum that DMG's <br />investigation of the alleged subsidence at the Tatum house was <br />complete. Ms. McCannon informed Ms. Tatum that, based on all of <br />the investigations that had been conducted concerning the damage <br />to the Tatum house, DMG had concluded that the Tatum house <br />is not within an area where mine subsidence related to <br />the Golden Eagle underground mining operations is <br />occurring or has occurred. Therefore, your residence <br />is not subject to mine subsidence impacts. <br />See AR II-13. <br />25. By letter dated August 23, 1995, Susan McCannon, Coal <br />Program Supervisor for DMG, informed Mr. Richard Seibel, Director <br />of OSM's Western Regional Coordinating Center that, after <br />reviewing the results of the joint OSM/DMG investigations, DMG <br />had concluded that no subsidence related to coal mining was <br />causing damage to the Tatum house. Ms. McCannon further asserted <br />that DMG had now responded to OSM's TDN in an appropriate manner. <br />Finally, Ms. McCannon requested in her letter that OSM issue a <br />decision in the matter either upholding the State response to the <br />TDN or overturning it. ee AR II-13. <br />26. By letter dated September 18, 1995, Mr. Richard Seibel, <br />Director of OSM's Western Regional Coordinating Center, informed <br />the Tatums and DMG that he had completed his informal review of <br />the February 4, 1994, decision by the OSM-AFO that the State had <br />responded appropriately to OSM TDN No. X93-020-370-000, <br />14 <br />
