<br />by Ms. Ann Tatum in letters of May 4, 1995 (AR II-26), May 11, <br />1995 (AR II-21), May 18, 1995, and May 24, 1995 (AR II-14). On <br />page one of her letter, Ms. McCannon stated: <br />While it is true that we have observed evidence of <br />movement of the upper walls in an outward motion, <br />absolutely no evidence of movement of the foundation of <br />the home has been observed by any of the parties. <br />Movement of the foundation is the critical indicator of <br />mine subsidence. Without evidence of movement of the <br />foundation we can make no finding except that mine <br />subsidence has not impacted the home. Further we <br />continue to believe that no subsidence related to the <br />1st north mains has occurred. <br />See AR II-5. <br />21. By letter dated June 21, 1995, Richard J. Seibel, <br />Director of the OSM Western Regional Coordinating Center, <br />responded to a request for information on the Tatum matter from <br />Senator Phil Gramm of the State of Texas. On page one of his <br />letter, Director Seibel informed Senator Gramm that OSM's <br />computer model showed little likelihood of subsidence damage to <br />the Tatum house. On pages one and two of his letter, Director <br />Seibel informed Senator Gramm that follow up inspections by OSM <br />and DMG experts confirmed the. conclusion of the computer model <br />that subsidence was not affecting the Tatum house. See AR II-3. <br />22. In a report issued on June 30, 1995, Dr. Jesse Craft, <br />an OSM subsidence expert, expressed his expert opinion that <br />subsidence had not caused the damage to the Tatum house. In <br />support of his conclusions, among other things, Dr. Craft noted <br />that the railroad track, which is located, unlike the Tatum <br />12 <br />
