We had previously been notified by
Mr. Brent Anderson that as point of law, all enforcement actions should be
sent through the resident agent per 34-33-110(2)(c), C.R.S. and Rule
2.03.4(1)(c). The permit application identifies C.T. Corporation System as
the resident agent on page I-2. Cyndy Ulibarri of C.T. Corporation System
called today and indicated that they have no historic record that Rockcastle
Coal Company has ever patronized their services. I then asked her if she
listed a Ryan, Inc., of Janesville, Wisconsin, and she answered
affirmatively. I told her to send the enforcement action to them.
Please clarify, in writing, the agency or person responsible to be the
resident agent for Rockcastle Coal Company.
Thank you for your prompt consideration of this matter.
Sincerely,
p i
Catherine W.
